These Terms & Conditions govern the use of the website and webshop operated by Daniel Ost Group NV.

By accessing our website, using our webshop or placing an order, you agree to these Terms & Conditions.

2. Scope

These Terms apply to:
use of the website;
online purchases made through the webshop;
remote orders confirmed by Daniel Ost Group NV, unless separate terms apply;
general interaction with our digital content.
Separate agreements apply to bespoke floral installations, weddings, events, hospitality projects, corporate services, landscape projects, artistic commissions and other tailor-made services. In case of conflict between these Terms and a signed agreement, the signed agreement prevails.

3. Contracting Party

The website and webshop are operated exclusively by Daniel Ost Group NV.
Any reference to “Daniel Ost”, “we”, “our” or “us” on the website, in the webshop, in order confirmations or in these Terms refers to Daniel Ost Group NV, unless expressly stated otherwise in writing.
For the avoidance of doubt, Daniel Ost Group NV operates independently from Mr. Daniel Ost as a private individual. Mr. Daniel Ost holds no role, position, mandate or liability within Daniel Ost Group NV. He is not an owner, shareholder, director, officer, employee, advisor, consultant or legal representative of Daniel Ost Group NV.
Likewise, Daniel Ost Group NV is not responsible or liable for any personal acts, omissions, statements, obligations, commitments, debts or liabilities of Mr. Daniel Ost.

No reference to the Daniel Ost name, brand, heritage, aesthetic, website, webshop, products or services shall be interpreted as creating any personal liability, representation, guarantee or commitment by Mr. Daniel Ost, unless expressly confirmed in writing by Daniel Ost Group NV and, where legally required, by Mr. Daniel Ost himself.
4. Use of the Website
You agree to use the website lawfully and respectfully.
You must not:
attempt to hack, disrupt or damage the website;
use automated scraping, extraction or harvesting tools without our written permission;
reproduce, copy, sell or exploit website content without authorisation;
upload or transmit malicious code;
infringe our intellectual property rights or those of third parties;
use the website for fraudulent, unlawful or misleading purposes.
We may suspend or restrict access to the website if we reasonably believe these Terms have been breached.

5. Product Information and Artistic Variation

We take care to present our products accurately. However, images, colours, dimensions and descriptions are indicative.
Flowers and botanical materials are natural, seasonal and perishable. Variations in colour, size, shape, variety, stem length and composition may occur.
We may substitute flowers, plants or materials with alternatives of equal or higher quality where required by seasonality, availability, quality standards or artistic judgement.
Such variations do not constitute a defect where the delivered creation corresponds reasonably to the ordered product and Daniel Ost standard.

6. Orders

An order placed through the webshop constitutes an offer to purchase the selected product.
The order is accepted when we confirm it by email or otherwise begin processing it. We reserve the right to refuse or cancel an order in the following cases:
product unavailability;
incorrect pricing or product information;
suspected fraud;
incomplete or incorrect customer information;
delivery not possible in the requested area or timeframe;
payment not authorised;
force majeure or supply-chain disruption.
If we cancel an order after payment, we will refund the amount paid, unless cancellation results from fraud or unlawful conduct.

7. Prices and Taxes

Prices are shown in euros, unless stated otherwise.
Prices include VAT where applicable. Delivery fees, premium delivery costs or other additional charges are shown at checkout or confirmed before order acceptance.
We may update prices at any time. Price changes do not affect orders already accepted, except in the case of obvious error.
If a product is listed with an incorrect price due to a typographical, technical or system error, we may cancel the order and refund any amount paid.

8. Payment

Payment must be made using the payment methods offered at checkout or otherwise confirmed by us.
Orders are processed only after payment authorisation or according to the payment terms expressly agreed in writing.
We use third-party payment providers for secure payment processing. We do not store complete payment card details.

9. Delivery

Delivery terms are set out in our Return & Refund Policy + Shipping Terms.
Delivery dates and time windows are indicative unless expressly confirmed by us in writing as guaranteed.
The customer is responsible for providing complete and accurate delivery details. If delivery cannot be completed because of incorrect information, unavailable recipients, restricted access or incomplete instructions, additional delivery costs may apply. For perishable products, failed delivery caused by customer or recipient circumstances does not entitle the customer to a refund.

10. Returns, Refunds and Withdrawal Rights

Returns, refunds and withdrawal rights are governed by our Return & Refund Policy + Shipping Terms.
Fresh flowers, plants, floral arrangements, bespoke products and personalised products are perishable and/or made to order. They are not subject to the statutory consumer right of withdrawal.
Consumers purchasing eligible non-perishable products online may have a statutory right of withdrawal within 14 calendar days of delivery, subject to the conditions set out in the Return & Refund Policy.

11. Legal Guarantee and Product Conformity

Mandatory legal guarantees apply where required by law.
For non-perishable consumer goods, this includes the legal guarantee for lack of conformity, subject to applicable conditions.
For fresh flowers, plants and botanical creations, conformity is assessed in light of their natural, seasonal and perishable character. Their lifespan depends on care, environment, temperature, handling, humidity and exposure after delivery.
Natural variation, seasonal substitution and changes resulting from improper care or environmental conditions after delivery do not constitute lack of conformity.

12. Customer Information

You agree to provide accurate, current and complete information when placing an order or contacting us.
You are responsible for ensuring that recipient details, delivery addresses, phone numbers and billing information are correct.
If you provide personal data of a recipient or third party, you confirm that you may lawfully provide that information for the intended purpose.

13. Gift Messages and Customer Content

Where gift messages or personalised text may be added, you are responsible for the content you provide.
We may refuse, edit or omit content that is unlawful, offensive, discriminatory, threatening, infringing or otherwise inappropriate.

14. Bespoke Services, Events and Projects

Weddings, events, floral installations, landscape projects, hospitality collaborations, corporate services and bespoke commissions are subject to separate proposals, order confirmations or contracts.
Unless expressly agreed otherwise, webshop prices and policies do not apply to bespoke services.
Deposits, staged payments, cancellations, creative rights, installation requirements, venue access, dismantling, staffing, transport, insurance and force majeure for such projects will be governed by the applicable agreement.

15. Intellectual Property

All content on the website, including but not limited to photographs, videos, floral designs, compositions, texts, names, logos, graphics, layouts, concepts and brand elements, is owned by or licensed to Daniel Ost Group NV and is protected by intellectual property laws.
You may not copy, reproduce, modify, distribute, publish, display, sell, license, create derivative works from or commercially exploit any website content without prior written permission.
The names, logos and brand elements associated with Daniel Ost may not be used without prior written authorisation.

16. Third-Party Links and Platforms

Our website may contain links to third-party websites, social media platforms, payment providers or external services.
We are not responsible for the content, security, terms or privacy practices of third-party websites or services.
Use of third-party platforms is subject to their own terms and policies.
17. Limitation of Liability
To the fullest extent permitted by law, Daniel Ost Group NV is not liable for:
indirect, incidental or consequential damage;
loss of profit, revenue, goodwill or opportunity;
damage resulting from misuse of products;
damage resulting from incorrect delivery information provided by the customer;
delay or non-performance caused by circumstances beyond our reasonable control;
website interruptions, errors or temporary unavailability;
third-party services, platforms or payment systems.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.

18. Force Majeure

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including but not limited to extreme weather, strikes, transport disruption, accidents, illness, pandemics, government measures, fire, flood, energy disruption, cyber incidents, supplier failure, crop failure, customs delays or other force majeure events.

Consumers may also seek guidance from the competent consumer mediation or dispute resolution bodies in Belgium or their country of residence, where applicable.
The former European Online Dispute Resolution platform has been discontinued and is no longer available.

20. Governing Law and Jurisdiction

These Terms are governed by Belgian law.
For consumers, this choice of law does not affect mandatory consumer protection rights under the law of their country of residence where such rights apply.
Subject to mandatory legal rules, disputes shall be submitted to the competent courts of Belgium, with jurisdiction in the judicial district of West Flanders, division Bruges.

21. Changes to These Terms

We may update these Terms from time to time. The updated version will be published on this page with a revised “last updated” date.
The Terms applicable to an order are those in force at the time the order is placed, unless mandatory law provides otherwise.
